Acceptance of these terms

By using herofound.org (the "Site"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Site. "HERO Foundation," "we," "us," and "our" mean HERO Foundation, a Nevada nonprofit corporation recognized as a 501(c)(3) public charity.

About this website

The Site describes HERO Foundation's mission and programs, tells the stories of the people we serve, and offers ways to donate, volunteer, and partner with us. Everything on the Site is general information about the Foundation. Our programs are delivered in person, by qualified instructors, under separate enrollment agreements.

Not medical, mental health, or dive-safety advice

The Site discusses the restorative effects of scuba diving and water-based activity on mental health, resilience, and readiness. This content is provided for general information and inspiration only. It is not medical advice, mental health treatment, or dive-safety instruction, and it is not a substitute for care from a licensed professional.

Scuba diving carries real risks. Never dive without proper training and certification, a current medical clearance where required, and supervision by a qualified instructor or dive professional. Nothing on the Site should be used to decide whether you are fit to dive.

Program participation

Taking part in any HERO Foundation program is subject to the program's own eligibility requirements, application process, enrollment agreement, assumption-of-risk and release documents, and medical clearance requirements. Nothing on the Site creates a right to participate, guarantees admission, or forms an agreement to provide services. Program availability depends on funding, instructor capacity, and conditions.

Donations

Donations are voluntary gifts to HERO Foundation and are processed by Clover, a payment service operated by Fiserv, on Clover's secure checkout page. Your use of that page is also subject to Clover's terms and privacy policy.

Intellectual property

The Site and its contents, including text, photographs, video, graphics, and layout, are owned by HERO Foundation or used with permission and are protected by copyright and other laws. The name HERO Foundation, the HERO badge, and Help Everyone Remain Operational® are trademarks of HERO Foundation.

You may view, print, and share pages from the Site for personal, noncommercial purposes, with attribution. You may not use our name, badge, or marks to suggest sponsorship or endorsement, reproduce our content commercially, or use photographs of our participants, without our written permission. Requests: info@herofound.org.

Acceptable use

You agree not to use the Site to do anything unlawful or harmful, including: attempting to gain unauthorized access to the Site or its host; interfering with its operation; sending malicious code; scraping or harvesting content or contact details for unsolicited marketing; impersonating HERO Foundation or anyone else; or misrepresenting your affiliation with us.

Third-party sites and services

The Site links to services we do not control, including Clover for donations, Instagram, LinkedIn, and Google Fonts. We are not responsible for their content, availability, or practices, and a link does not mean we endorse them. Their terms and policies apply when you use them.

Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, HERO Foundation disclaims all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do our best to keep the Site accurate and available, but we do not promise that it will be error-free, uninterrupted, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, HERO Foundation and its directors, officers, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Site, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

This section concerns the website only. Participation in our in-person programs is governed by the agreements and releases you sign when you enroll.

Indemnification

You agree to defend, indemnify, and hold harmless HERO Foundation and its directors, officers, employees, volunteers, and agents from claims, damages, and expenses, including reasonable attorneys' fees, arising from your violation of these terms or your misuse of the Site.

Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute arising out of these terms or your use of the Site will be brought exclusively in the state or federal courts located in Nevada, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms from time to time. The date at the top shows the latest revision. Continued use of the Site after a change means you accept the updated terms.
